European Court to deliver judgement on "Chiragov and Others v. Armenia" case
The European Court of Human Rights will hold hearing on “Sargsyan v. Azerbaijan” and “Chiragov and Others v. Armenia” cases today.

The European Court of Human Rights will be delivering a Grand Chamber judgment in the case of Chiragov and Others v. Armenia (application no. 13216/05) at a public hearing on 16 June 2015 at 4:00 p.m. (at 7.00 by Baku time) in the Human Rights Building, Strasbourg.

The case concerns the complaints by Azerbaijani refugees that they have been unable to return to their homes and properties in the district of Lachin, from where they were forced to flee in 1992 during the Armenian-Azerbaijani conflict over Nagorno-Karabakh.

The applicants complain that the loss of all control over, and of all potential to use, sell, bequeath, mortgage, develop and enjoy their properties in Lachin amounts to a continuing violation of Article 1 of Protocol No. 1 (protection of property) to the European Convention on Human Rights. They also complain that their inability to return to the district of Lachin constitutes a continuing violation of 2 Article 8 (right to respect for home and private and family life) of the Convention. Furthermore, they complain that no effective remedies were available to them in respect of their complaints, in breach of Article 13 (right to an effective remedy). Finally, they submit that, in relation to the other complaints, they were discriminated against on the basis of their ethnic origin and religious affiliation, in violation of Article 14 (prohibition of discrimination).

It is noteworthy that, on the same day, the ECtHR also started examining a group of Armenians’ lawsuit (“Sargsyan v. Azerbaijan”) that was filed against Azerbaijan.
